Welcome to MT4 VPS. By accessing or using our MetaTrader 4 VPS hosting service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, subscribing to our service, or using any part of MT4 VPS, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our service.

2. Service Description

2.1 VPS Hosting

MT4 VPS provides virtual private server (VPS) hosting specifically designed for MetaTrader 4 trading platforms. Our service includes:

• Dedicated CPU core allocation
• 2GB guaranteed RAM
• 50GB SSD storage
• Remote VNC access via web browser
• File management dashboard
• 99.9% uptime SLA (Service Level Agreement)

2.2 Free Trial

New users receive a 3-day free trial with no credit card required. After the trial period ends, you must subscribe to continue service. Trial data is automatically deleted if you do not subscribe.

3. Account Registration

3.1 Eligibility

• You must be at least 18 years of age
• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials
• One account per person; multiple accounts are prohibited

3.2 Account Security

You are solely responsible for all activities under your account. Notify us immediately at security@mt4-vps.com if you suspect unauthorized access.

4. Pricing and Payment

4.1 Subscription Fees

• Monthly Plan: $10.00 USD per month
• Payments processed via Stripe on a recurring basis
• All prices are in USD and exclude applicable taxes

4.2 Billing

• Billing begins after your free trial period ends
• Subscriptions automatically renew unless canceled
• Payment failures may result in service suspension
• No pro-rated refunds for partial months

4.3 Refund Policy

• 7-Day Money-Back Guarantee: Full refund if canceled within 7 days of initial payment (after trial)
• Refunds processed within 5-10 business days via original payment method
• No refunds for accounts terminated due to Terms violations

5. Acceptable Use Policy

5.1 Permitted Use

Your VPS instance may only be used for:

• Running MetaTrader 4 trading platforms
• Executing Expert Advisors (EAs) and automated trading strategies
• Managing trading indicators and scripts
• Legitimate forex and financial trading activities

5.2 Prohibited Activities

You may not use our service for:

• Illegal activities, fraud, or money laundering
• Cryptocurrency mining or distributed computing unrelated to trading
• Port scanning, network attacks, or hacking attempts
• Hosting websites, mail servers, or file sharing services
• Proxy servers, VPNs, or Tor exit nodes
• Spamming, phishing, or distributing malware
• Excessive resource consumption that degrades service for others
• Reselling or subletting VPS access to third parties

Violation of this policy will result in immediate account termination without refund.

6. Trading Disclaimer and Liability Limitation

6.1 No Financial Advice

• We do not provide trading advice, signals, or investment recommendations
• Any trading decisions are made solely at your own discretion and risk
• Past performance does not guarantee future results

6.2 Risk of Financial Loss

FOREX TRADING CARRIES SUBSTANTIAL RISK OF LOSS. You acknowledge that:

• You may lose some or all of your invested capital
• Automated trading (Expert Advisors) does not guarantee profits
• Market volatility can result in rapid and significant losses
• Failure to set proper stop-loss orders or risk management parameters can result in total account loss

6.3 No Liability for Trading Losses

MT4 VPS IS NOT LIABLE FOR ANY TRADING LOSSES, including but not limited to:

• Losses resulting from your trading strategies or Expert Advisors
• Losses due to failure to set stop-loss orders or proper risk management
• Losses caused by market volatility, broker execution issues, or slippage
• Losses from technical issues beyond our control (broker outages, internet disruptions, force majeure events)
• Losses from your failure to monitor positions or account balance

You are solely responsible for:

• Implementing proper risk management strategies
• Setting appropriate stop-loss and take-profit levels
• Monitoring your trades and account equity
• Understanding the risks of leveraged trading
• Ensuring your Expert Advisors are properly configured and tested

6.4 Service Uptime and Performance

While we maintain a 99.9% uptime SLA, we are not liable for:

• Trading losses during planned or unplanned service outages
• Missed trading opportunities due to connectivity issues
• Data loss (you must maintain your own backups)
• Third-party service failures (brokers, data providers, internet backbone)

7. Service Level Agreement (SLA)

7.1 Uptime Target

We commit to a 99.5% monthly uptime target. If we fail to meet this target:

• 99.5% - 99.8% uptime: 10% service credit
• 99.0% - 99.4% uptime: 25% service credit
• Below 99.0% uptime: 50% service credit

Exclusions: Scheduled maintenance (announced 48 hours in advance), force majeure events, user-caused issues, or third-party failures.

7.2 Claim Process

Service credit claims must be submitted within 7 days of the incident to support@mt4-vps.com with documentation of downtime.

8. Data and Backups

8.1 Your Responsibility

• You are responsible for backing up your data, Expert Advisors, and configurations
• We perform automated daily backups, but these are for disaster recovery only
• We do not guarantee backup restoration for individual user requests

8.2 Data Deletion

• Account cancellation results in permanent deletion of all VPS data within 30 days
• Download your files before canceling (no recovery possible after deletion)

9. Suspension and Termination

9.1 Suspension

We may suspend your service immediately for:

• Payment failure (service resumes upon successful payment)
• Violation of Acceptable Use Policy (pending investigation)
• Resource abuse or excessive usage

9.2 Termination

We reserve the right to terminate your account for:

• Repeated Terms violations
• Fraudulent activity or chargebacks
• Illegal use of the service

Terminated accounts are not eligible for refunds.

9.3 Your Right to Cancel

• Cancel anytime via your account dashboard
• Cancellation takes effect at the end of your current billing cycle
• Download your data before cancellation (no access after termination)

10. Intellectual Property

10.1 Your Content

• You retain all rights to your Expert Advisors, trading strategies, and data
• We do not claim ownership of any files you upload
• We will not access, use, or share your proprietary trading strategies

10.2 Our Service

• MT4 VPS name, logo, and service infrastructure are our intellectual property
• You may not reproduce, copy, or resell our service

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MT4 VPS provides the service "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 3 months
• We are not responsible for third-party services (brokers, MT4 platform, market data)

12. Indemnification

You agree to indemnify and hold harmless MT4 VPS from any claims, damages, or losses arising from:

• Your use of the service
• Your trading activities and strategies
• Violation of these Terms
• Violation of applicable laws or regulations

13. Modifications to Terms

We may update these Terms at any time. Changes will be posted with an updated "Last Updated" date. Continued use of the service constitutes acceptance of modified Terms. Material changes will be communicated via email.

14. Governing Law and Disputes

• Governing Law: These Terms are governed by the laws of [Your Jurisdiction]
• Dispute Resolution: Any disputes must first be resolved through good-faith negotiation
• Arbitration: Unresolved disputes will be settled through binding arbitration
